ACCEPTANCE OF THESE TERMS

Welcome to EcoHomeClean! These Terms of Use (“Terms”) govern your access to and use of our platform, services, and website (collectively, the “Platform”). By accessing or using the Platform, you agree to these Terms. If you do not agree, you may not use the Platform.

All references to “we,” “us,” or “our” mean EcoHomeClean and its affiliates. References to “you” or “your” mean any individual or entity using the Platform, including their representatives, heirs, assigns, and successors.

By using our Platform on behalf of a business or organization, you confirm that you have the authority to bind that entity to these Terms, and “you” will refer to that entity and its representatives.


 

MODIFICATIONS TO THE TERMS

EcoHomeClean may modify these Terms at any time. Changes will be effective 30 days after being posted on the Platform or when we notify you through other means, such as email or account notifications. Your continued use of the Platform after this period constitutes your acceptance of the updated Terms.


 

ADDITIONAL TERMS AND POLICIES

Our Privacy Policy outlines how we collect and use your information and is incorporated into these Terms by reference. Some services or features of the Platform may be subject to additional terms and conditions, which will take precedence in case of conflict with these Terms.


 

ELIGIBILITY

The Platform is available only to individuals who are at least 18 years old and legally capable of entering binding agreements. By using the Platform, you confirm that you meet these requirements.


 

ACCOUNT REGISTRATION

Certain features of the Platform require creating an account. You agree to provide accurate and current information and keep it updated. You are responsible for safeguarding your password and all activities under your account. If unauthorized use occurs, notify us immediately.

Your account is non-transferable without written permission from EcoHomeClean.


 

YOUR LICENSE TO USE THE PLATFORM

We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You agree not to copy, modify, distribute, or exploit any part of the Platform or its content without explicit permission.


 

USER CONTENT

You may post, upload, or submit content (“User Content”) to the Platform. By doing so, you grant EcoHomeClean a worldwide, royalty-free, irrevocable license to use, display, modify, and distribute your content for promotional and operational purposes.

You are solely responsible for your User Content and must ensure it does not violate any laws or infringe on third-party rights. EcoHomeClean reserves the right to remove content at its discretion.

 

Prohibited Activities

As a user of the EcoHomeClean platform, you agree not to engage in the following activities:

  • Misuse or misrepresent the EcoHomeClean platform, including impersonating another user, misrepresenting your qualifications, or posting content in incorrect categories or areas.
  • Use automated systems (e.g., bots, scrapers) to access or collect information from the platform without prior written approval, except for public search engines creating searchable indices.
  • Copy, misuse, or replicate content or information from the platform for competitive or unauthorized purposes.
  • Interfere with the platform’s infrastructure or functionality, bypass security measures, or introduce harmful software or technologies.
  • Circumvent payment obligations, attempt to bypass service fees, or manipulate billing structures.
  • Collect, share, or sell personal information from users without explicit consent and in compliance with applicable privacy laws.
  • Violate local, state, or federal laws or regulations while using the platform.
  • Contact users in ways that are unwanted or prohibited, including excessive calls, emails, or texts.
  • Solicit EcoHomeClean service providers or customers for unrelated business opportunities or employment.
  • Submit harmful, unlawful, or inappropriate content, including materials that are defamatory, discriminatory, harassing, or otherwise objectionable.
  • Advertise or promote unrelated or competing services, including but not limited to lending services, directory services, multi-level marketing schemes, or services based outside of supported regions.
  • Undermine reviews or rating systems by manipulating them or engaging in fraudulent practices.
  • Fail to deliver promised services unless due to a customer failing to meet agreed terms, such as non-payment.
  • Use the platform to agree to services you do not intend to fulfill or pay for.
  • Create multiple accounts without prior approval.
  • Share subscription benefits with unauthorized users or households.
  • Engage in activities that conflict with the purpose and integrity of the EcoHomeClean platform.

 

Fees and Payments

 

Service Fees:
EcoHomeClean may charge service providers fees for leads, bookings, or other platform benefits. Fees may be deducted from customer payments or charged to the stored payment method. A valid payment method must be maintained on file, and users agree to all applicable charges based on terms provided at the time of service.

 

Budgets and Spending Limits:

Service providers may set weekly spending limits (“Budgets”) to control how much they are willing to spend on leads or services. Budgets may auto-renew or adjust based on changes to spending periods unless manually updated. EcoHomeClean is not responsible for guaranteeing the number or quality of leads generated by specific budget settings.

 

Payment Timing:

Charges for fees may occur at various points based on account history. New users or accounts with limited history may be charged immediately for each lead or booking. Established accounts may be charged periodically based on accumulated fees or thresholds.

 

Default Payment Methods:
If the default payment method fails, EcoHomeClean reserves the right to charge any other payment method associated with your account.

 

Penalty Fees:
Penalty fees may be applied for violations such as late payments, fraud, or misconduct. These fees will be clearly disclosed where applicable.

 

Taxes:
Fees and charges may include applicable taxes. Users are responsible for understanding and fulfilling their own tax obligations, including sales tax or other reporting requirements.

 

Communication Tracking

To ensure compliance and accurate fee calculations, EcoHomeClean may track communications between customers and service providers. This may include anonymizing contact details or tracking text messages facilitated through the platform. However, content will not be reviewed without prior consent.

 

 

Subscriptions

EcoHomeClean Plus Subscription:
Some users may opt for a subscription-based service that includes additional benefits. Subscriptions auto-renew unless canceled at least five business days before the renewal date. Subscription fees are non-refundable unless otherwise specified. Businesses or unauthorized entities are prohibited from using these benefits.

 

 

Enforcement and Termination

EcoHomeClean reserves the right to suspend or terminate accounts for violations of these terms. Users agree to cooperate with any investigations related to suspected misconduct.

 

Marketplace Payments

At EcoHomeClean, we aim to provide a smooth and transparent payment process for both our clients and cleaning professionals. Payments facilitated through our platform are handled by Stripe, our trusted payment processing partner. Please note that EcoHomeClean acts solely as a facilitator for Marketplace Payments and is not a party to any cleaning services provided. Marketplace Payments are only permitted for services, not for the purchase of tangible goods.

By using EcoHomeClean as a service provider, you authorize us to act as your agent for processing payments via Stripe. Once a payment is made through our platform, the client’s payment obligation is fulfilled as if paid directly to the service provider.

EcoHomeClean does not directly provide or subcontract cleaning services unless otherwise stated in a separate contract. Clients contract directly with cleaning professionals for their services, and all obligations to perform or remedy issues with those services rest with the service provider.

Cleaning professionals must agree to Stripe’s Connected Account Agreement and Stripe Services Agreement, ensuring compliance with their requirements. A social security number or employer identification number is required to receive payments. By using EcoHomeClean, service providers agree to share accurate information for payment processing and authorize us to share transaction details with Stripe.

 

Disputes and Adjustments:
EcoHomeClean may resolve payment disputes at its discretion, including reversing or withholding payments. We reserve the right to investigate and decide disputes regarding payments and refunds, ensuring fairness for both parties.

 

Client Payment Responsibilities:
Clients agree to pay service fees promptly using their preferred payment method. Keeping payment information updated and secure is crucial. Clients should not share financial details with others, and EcoHomeClean disclaims liability for unauthorized disclosures.

 

Payment Methods:
We accept various payment methods, including credit, debit, and bank transfers. If you use a bank account for payments, you authorize Stripe to handle ACH transactions. Clients are responsible for any fees associated with failed payments, and outstanding balances may incur collection costs.


 

Promotions

EcoHomeClean may offer exclusive promotions such as discounts, free trials, or credits. Eligibility depends on specific requirements, and promotions may be revoked at our discretion. Users must meet all terms communicated during the promotional offer, and promotions cannot be combined unless explicitly stated.


 

Sponsored Listings

To enhance visibility, EcoHomeClean allows cleaning professionals to feature their services in sponsored listings, which will be clearly marked in search results. Quality standards may apply for eligibility, ensuring a reliable experience for clients.


 

Disputes Between Users

While we encourage users to resolve disputes independently, EcoHomeClean may offer mediation services to facilitate resolutions. Participation in mediation is voluntary and conducted in good faith. However, EcoHomeClean is not obligated to mediate disputes and cannot guarantee specific outcomes.


 

Intellectual Property Rights

EcoHomeClean content, including our branding, design, and materials, is protected by copyright, trademark, and other intellectual property laws. Users may not copy, reproduce, or use EcoHomeClean’s proprietary materials without explicit permission.

All trademarks, service marks, and logos remain the property of their respective owners. Unauthorized use of EcoHomeClean’s intellectual property is strictly prohibited.

FEEDBACK

By providing any feedback, comments, questions, or suggestions regarding EcoHomeClean or its services, including our platform (“Feedback”), you represent and warrant that:

(a) You have the legal right to disclose the Feedback.
(b) The Feedback does not infringe upon the rights of any individual or entity.
(c) The Feedback does not include confidential or proprietary information belonging to any third party.

By submitting Feedback, you agree that:

(i) EcoHomeClean has no obligation of confidentiality, express or implied, regarding the Feedback.
(ii) We may already be considering or developing ideas similar to the Feedback.
(iii) You grant EcoHomeClean an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, modify, create derivative works from, publish, distribute, and sublicense the Feedback.
(iv) You waive and agree to not assert any moral rights related to the Feedback against EcoHomeClean or its users.

This Feedback section will survive any termination of your account or use of the platform.


COPYRIGHT POLICY

EcoHomeClean expects all users to respect copyright laws. If a user repeatedly infringes on copyright rights, their account may be suspended or terminated. For more details, please refer to our Copyright and DMCA Policy.


NO ENDORSEMENT OR WARRANTY

EcoHomeClean does not endorse, guarantee, or make representations (other than explicitly stated) about any user, service provider, or services listed on the platform. EcoHomeClean does not perform services directly and disclaims all liability related to the services provided by independent professionals.

Any designations such as “verified,” “vetted,” “top-rated,” or similar are based on platform-specific criteria and do not serve as a certification of a provider’s expertise, qualifications, or trustworthiness. Users must exercise due diligence and care when interacting with others via the platform.

While EcoHomeClean may provide home care tips or advice, these are general suggestions and not tailored to individual homes or needs. Always consult licensed professionals for specific advice.

Links on our platform to third-party websites or services are for user convenience only. EcoHomeClean is not responsible for their content or performance.

By using our platform, you agree that any legal recourse for disputes lies between you and the other parties involved, not EcoHomeClean.


SANCTIONS FOR VIOLATIONS

EcoHomeClean may take action for violations of these terms, including but not limited to:

  • Removing user content.
  • Limiting or suspending account access.
  • Withholding funds.
  • Terminating accounts.
  • Informing other users of violations.
  • Investigating and cooperating with legal authorities.

ACCOUNT SUSPENSION OR TERMINATION

EcoHomeClean may suspend, deactivate, or terminate your account at its sole discretion, with or without cause or notice. Actions may include:

(a) Disabling account access and associated services.
(b) Notifying others of your account’s status.
(c) Forfeiting any compensation for canceled services due to account termination.

Users may terminate their accounts at any time through the platform settings. Please note that account termination does not obligate EcoHomeClean to delete or return user-generated content. For data deletion requests, refer to our Privacy Policy.


ARBITRATION AND CLASS ACTION WAIVER

Please read this section carefully as it impacts your legal rights.

You and EcoHomeClean agree to resolve all disputes through binding arbitration, governed by the Federal Arbitration Act, except for intellectual property claims or small claims court matters.

Key Points:

  1. Initial Resolution: Attempt to resolve disputes informally by contacting EcoHomeClean support.
  2. Arbitration Process: If unresolved within 30 days, disputes will be settled via binding arbitration.
  3. Class Action Waiver: Claims must be filed individually, not as part of a class or collective action.

You may opt out of the arbitration agreement within 30 days of first using the platform by sending a written request to opt-out@ecohomeclean.com.

Arbitration will be conducted by an approved provider, and costs will follow the rules of the arbitration service.

This arbitration agreement, including the class action waiver, will survive the termination of your account.

Exceptions:

  • Intellectual property claims can be brought to state or federal courts.
  • Small claims within the jurisdiction of small claims court can also be filed there.

For any updates to these terms, EcoHomeClean will provide a 30-day notice, with changes applying prospectively.
